AMRI (NASDAQ: AMRI) today announced that it along with sanofi-aventis
U.S. LLC, has filed a motion for a preliminary injunction in the United
States District Court for the District of New Jersey seeking to enjoin
Dr. Reddy’s Laboratories, Ltd. and Dr. Reddy’s Laboratories, Inc. (Dr.
Reddy’s) from the commercial distribution of generic versions of
Allegra-D® 24 Hour (fexofenadine HCl 180 mg and pseudoephedrine HCl 240
mg) Extended-Release Tablets in the U.S. This action is in response to
the March 17, 2010 approval of Dr. Reddy’s generic version of Allegra-D®
24 Hour by the FDA.
In September 2009, AMRI filed a patent infringement lawsuit in the
United States District Court for the District of New Jersey against Dr.
Reddy’s for infringement of one of AMRI’s patents related to the
manufacturing process for the active ingredient in Allegra® , Allegra-D®
12, and Allegra-D® 24 Hour, which issued in 2008. Sanofi-aventis U.S. is
now joining AMRI in this lawsuit.
Regardless of the outcome of the preliminary injunction motion, AMRI
will continue to forcefully and vigorously defend its intellectual
property.
