In Connection with NYSE Euronext's Acquisition of the American Stock Exchange, HOLDRS(SM) Trusts to Be Transferred from the American Stock Exchange to NYSE Arca

Merrill Lynch, Pierce, Fenner & Smith Incorporated, in its capacity as the initial depositor in each of the issuer trusts set forth in the table below, today announced that, in connection with NYSE Euronext’s acquisition of the American Stock Exchange ("Amex”), the listing of the HOLDRS^SM Trusts set forth below (the "Securities”), which are currently listed on the NYSE Alternext US, LLC (formerly American Stock Exchange), will be transferred to NYSE Arca. The voluntary NYSE Alternext US, LLC delisting of the Securities is occurring in order to transfer the listing of such Securities to NYSE Arca due to the acquisition of the Amex by NYSE Euronext and to comply with NYSE Euronext’s plans to consolidate all listed exchange-traded funds and structured products on NYSE Arca.

The transfer in listing of each of the Securities is expected to occur on or about November 24, 2008.
